A Suffolk man with an “appalling” criminal record has been made the subject of a criminal behaviour order (CBO) banning him from swearing and being drunk in public.
Sentencing 28-year-old David Learmonth at Ipswich Crown Court, Judge Rupert Overbury said he had a history of committing offences while he was drunk.
Learmonth, of Burnham Way, Lowestoft, admitted being in breach of a suspended prison sentence, threatening behaviour, shoplifting, assault by beating, absconding while on bail and obstructing a police officer.
He was jailed for 78 weeks and made the subject of an indefinite criminal behaviour order banning him from swearing or drinking in a public place, being drunk in a public place, and drinking an open alcoholic drink in a public place.
The court heard that because of the time he had spent in custody he would be released from prison almost immediately.
Judge Overbury said Learmonth had an “appalling” record and warned him that the maximum sentence if he breached the CBO was up to five years’ imprisonment.
