A North Walsham man has decided not to take up his seat on the town council - despite being voted on.
Glenn Burrows, 32, was one two Liberal Democrat candidates who stood in the North Walsham West ward by-election last month.
However, he was suspended by his party before voters went to the polls after being charged with fraud.
Mr Burrows has opted not to sign a declaration of office to take up his seat and a casual vacancy has now been declared.
Town clerk Nick Clancy said electors in North Walsham West ward now have until August 14 to request an election to fill the vacancy, otherwise it will be filled by co-option.
Mr Burrows, of Princes Street, is charged with one count of obtaining services dishonestly, under the Fraud Act, and one count of acquiring criminal property.
He has been bailed to appear before Norwich magistrates on August 4.
Labour's Elaine Addison was also elected on to the council after winning the North Walsham West ward by-election with 229 votes to Mr Burrows' 210. Fellow LibDem Rob Scammell just missed out with 209 votes.
