Have my comprehension skills gone awry this morning- where does it say that Gooda has a record of convictions for violent assault?
yes he should have walked away- and that is half the problem today, everyone thinks they have to settle a score or take offence too easily, or play the big man. And perhaps he should have stopped to think that he might have been more capable of landing an effective punch than the man in the street, but a bit hard to convict him if the intention was not to do lasting harm.

"After the jury returned its verdict, John Farmer, prosecuting, told the
court that Gooda had previous convictions for common assault in 2001,
assault occasioning actual bodily harm in 2003 for which he was
sentenced to four months in a young offenders institution, and another
conviction in 2004 for driving with excess alcohol."
If you punch someone so hard three times that you kill them , then the intention was clearly to do harm. If Gooda had been a bus driver or whatever , then with his history of violence he would be doing at least 12 months in jail. He has walked away free because he is a soldier ,what other conclusion is there ?

I`m sure that will be a great comfort to the relatives of the victim of his violent assault. So if you are a serving soldier , you can do what you like. Does this largesse apply to the police , nurses , teachers etc ? , or just the military ?

Daniel Gooda, who was yesterday cleared of manslaughter and common assault but found guilty of affray, will fly out to Afghanistan next week after his Honour Judge Leonard QC sentenced him to 28 weeks in prison suspended for 12 months.
Norwich Crown Court had heard that Gooda's special skills - which include speaking an Afghan language - were important to the army's work in the war-torn country and that he was booked on a plane to Afghanistan on Thursday.
As previously reported, the jury took less than four hours to find Gooda not guilty of the manslaughter of Timothy Moore, 30, a father-of-two from Templemere in Norwich.
"An affray is defined at common law as a fight between two or more persons in a public place so as to cause terror to the public....
"'Affray' is derived from the French word effrayer, meaning to affright.
"Thus, in order to prove the offense, the State must prove beyond a reasonable doubt three essential elements of the crime: (1) that there was a fight between two or more persons; (2) that the fight occurred in a public place; and (3) that the fight caused terror to persons who qualify as members of the public."
MKJ. I just can't see why you are having such a problem accepting the facts of this case.
Too much drink,two men got fighting, (unfortunately one died) six of one and half a dozen of the other.
Suppose you will be happy, if Gooda has to have a slow ride home through Wootton Basset.

I will be happy if the law applies equally to everyone , whatever your occupation. Someone who punches someone else to death , having previous convictions for violence , and found guilty of affray would be sent to prison . If the military when off duty are subject to a different interpretation of the law , please explain to us all the the morality and logic of it.

As far as I know the law is equal to everyone. He was charged as anyone else, and found guilty as anyone else.
And sentenced as anyone else would be. The judge taken in all the mitigating circumstances as he would with any other person.

after living in the area for 6 years i sa if you do something wrong drunk or not you should get the full whack of the law thrown at you Alcohol is not an excuse its the reason and going one step further what is wrong in haveing someone banned from having alcohol for 2 3 yyears???

He also kicked a policeman when he was arrested. Let's hope another soldier in Afghanistan doesn't bear the brunt of his anger.
